| Please carefully read ALC Communications' (ALC)
Acceptable Usage Guidelines for personal Internet accounts. These guidelines are designed
to protect our subscribers from abuse of service. In addition, if you are planning on publishing personal web pages, please read the Terms of Service Addendum and the Page Content Guidelines which describe ALC's criteria for personal web pages. These guidelines are designed to promote the free flowing exchange of ideas and at the same time maintain standards consistent with the Internet community and the societies of the world at large. ALC Communications Acceptable Use Guidelines ALC Communications Member Terms of Service These Terms and Conditions of use constitute an agreement between ALC and you regarding the provision of our services to you, and your use of them. By using our services, you acknowledge these terms and conditions, and agree to be bound by and adhere to them. These terms and conditions may be amended from time to time at ALC's discretion. 1.GENERAL: We ask you to follow the rules on the Internet and not do anything that would harm our network or someone else's network as a result of your actions. We also ask you to be responsible for the software you use, and for the charges you incur while you are connected. Finally, we agree to work with you to resolve disputes, but if we can not agree on a solution, our liability is limited to the amount of your current monthly charges. To assume greater liability on our behalf would require us to charge higher rates for our service. These points are outlined below: 2.ALC services may only be used for lawful purposes. Transmission or storage of any information, data, or material in violation of any US or State law or regulation is prohibited. The subscriber agrees to indemnify and hold harmless ALC from any claims resulting from the subscriber's use of the service which damages either the subscriber or another party or parties. Any access to other networks through ALC must comply with the rules imposed by the other network. 3.The subscriber agrees to follow general Internet etiquette when sending messages to news groups and email recipients. The subscriber will refrain from advertising in those areas of the Internet that do not expressly allow advertising. "Spamming", and other forms of unwelcome advertising, is strictly prohibited. 4.Only one login is allowed per account. Multiple concurrent logins under a single account will be billed at $1.00 per hour or fraction of an hour per additional concurrent session. 5.ACCESS TO OBJECTIONABLE MATERIALS: ALC provides a means of access to information that includes information generally available through the Internet, and ALC exercises no control whatsoever over the content of the information that can be accessed through its service. USE OF ANY INFORMATION OBTAINED THROUGH ALC's SERVICES IS AT YOUR OWN RISK. BY SUBSCRIBING TO ALC's INTERNET ACCESS, YOU REQUEST ACCESS TO ANY AND ALL INFORMATION AVAILABLE THROUGH THE INTERNET. CERTAIN INFORMATION MAY BE INAPPROPRIATE FOR MINORS AND OFFENSIVE TO YOU. ALC CANNOT INSURE THAT THIS MATERIAL WILL NOT BE AVAILABLE TO YOU OR OTHERS, INCLUDING MINORS, WHOM YOU MAY ALLOW ACCESS THROUGH YOUR ACCOUNT, AND IT IS SOLELY YOUR RESPONSIBILITY TO EXERCISE CONTROL OVER SUCH ACCESS. 6.PAYMENT LIABILITY: Payment for ALC services is due in advance, and at monthly, quarterly or annual intervals thereafter. Monthly service is not prorated. If your check is returned or dishonored for any reason you agree that within one week of notice you will pay up your account and pay ALC's $20 returned check fee. Credit card subscribers agree to pay all billed amounts according to the card issuer agreement.You are responsible for ALL charges incurred by the use of your login name. If payment is not made within 5 days of the due date your account will be suspended until payment is received. All accounts are transferrable. 7.Subscriber agrees that ALC has the right to delete any and all information stored in the subscriber's account when the account is terminated, for any reason, by either ALC or by the customer. ALC also reserves the right to delete any and all information stored in the subscriber's account should the subscriber exceed the amount of personal web space allotted for them by their subscription. 8.Subscriber certifies that he or she is at least 18 years of age. It is the responsibility of the subscriber to keep ALC informed in the event the subscriber's mailing address is changed. ALC will cooperate with law enforcement authorities if an account is opened under fraudulent pretenses. ALC reserves the right to suspend service at any time, for any reason, without advance notice. 9.LIMITED WARRANTY. ALC warrants that, if a subscriber is dissatisfied with the service, ALC will, upon notification from the subscriber to ALC, cancel the service and discontinue future billings. Other than the foregoing, no warranty is made by ALC regarding any information, services, or products provided through, in connection with, or by ALC, and ALC expressly disclaims any and all warranties, including without limitation: 1.any warranties as to the availability, accuracy, or content of information, products, or services; and 2.any warranties of merchantability or fitness for a particular purpose. 10.LIMITED LIABILITY. The liability of ALC, including without limitation, any liability for damages caused or allegedly caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, communication line failure, theft or destruction of or unauthorized access to, alteration of, or use of records, whether for breach of contract, tortuous behavior, negligence, or under any other cause of action, shall be strictly limited to the amount paid by or on behalf of the subscriber to ALC for the current month. 11.Use of an ALC account constitutes acceptance of these Terms and Conditions. Definition of Unlimited Access: Unlimited Access means that there is no explicit limit on usage. You are free to use the service as much as you wish whenever you wish, but it is required that you are actively using the service whenever you are connected. Connections which are not actively in use will be disconnected after 20 minutes. If a connection is kept alive for the express purpose of maintaining a connection without any human interaction (such as with a 'ping' program), it will be seen as a violation of the conditions of use. This is grounds for expulsion from the service. ALC Communications Terms of Service and Page Content Guidelines ALC Communications Member Terms of Service Addendum ALC is not responsible for the content of any personal home page, and the opinions and views expressed in the personal home pages do not necessarily reflect those of ALC. The contents of the personal home pages are not reviewed in any way before they appear on ALC. We reserve the right to remove any file from the system which is brought to our attention and which we find, in our sole discretion, violates these page content guidelines, or otherwise is in violation of the law. ALC does not actively monitor the content of personal home pages, but will investigate complaints of violations of these guidelines. Members are solely responsible for everything contained in their own personal home pages. ALC does not verify, endorse, or otherwise vouch for the contents of any personal home page. Members can be held legally liable for the contents of their personal home pages and may be held legally accountable if their personal home pages include, for example, copyrighted, trademarked, patented, or trade secret material without the permission of the author or owner or includes defamatory comments. In the event that ALC receives a complaint that the contents of a personal home page infringe intellectual property rights or is otherwise unlawful, ALC shall request substantiation from the complaining party, for example, substantiation of proof of ownership in the form of a trademark, service mark, or copyright registration and, if ALC believes it to be appropriate, will contact the member and request a response. ALC reserves the right to release current or past member information in the event ALC believes that accounts are in violation of the terms of service or content guidelines, used to commit unlawful acts, or if the information is subpoenaed. ALC reserves the right to deny membership to repeat offenders of these guidelines or terms of service. ALC reserves the right to amend or change these guidelines at any time and without notice. ALC reserves the right to use images of member's home pages for promotional and other purposes. ALC reserves the right to create hypertext links to a member's home pages for promotional and other purposes. ALC account descriptions specify limits on bandwidth and disk utilization, and use in excess of said limits is not permitted. Bandwidth utilization is determined by the total number of bytes transferred from an account's allotted disk space. Disk utilization is determined by the total number of bytes required to store an account's personal web pages, FTP-accessible files, and mail data. In the event ALC determines that an account is exceeding the bandwidth or disk utilization, the account owner will be notified by e-mail. If the excess use continues for more than 7 days after such notification, the owner may be requested to upgrade the account's service agreement or to modify the activity creating the excess use. If excessive bandwidth or disk space utilization is determined to adversely affect ALC's ability to provide service, immediate action will be taken. The account owner will be notified by email as soon as practicable. Page Content Guidelines Summary ALC has carefully developed the following page content guidelines to promote the free flowing exchange of ideas about your interests, activities, and hobbies, and at the same time maintain standards consistent with the Internet community and the societies of the world at large. Please refrain from using your personal home page for the following activities: Providing material that is grossly offensive to the Web community including blatant expressions of bigotry, racism, hatred, or profanity Promoting or providing instructional information about illegal activities, or promoting physical harm or injury against any group or individual Commercial purposes, including but not limited to the following: Offering for sale any products or services Soliciting for advertisers or sponsors Displaying a sponsorship banner of any kind, including those that are generated by banner or link exchange services, with the sole exception of the Internet Link Exchange Displaying banners for services that provide cash or cash-equivalent prizes to users in exchange for hyperlinks to their web site. Promoting or soliciting for participation in direct marketing or pyramid schemes Conducting raffles or contests that require any type of entry fee Providing material containing nudity or pornographic material of any kind, or material that exploits images of children under 18 years of age Using your page (or directory) as storage for remote loading or as a door or signpost to another server Using copyrighted material without the prior permission from the author Violating Internet standards for the purpose of promoting your home page. Developing pages that consist of hyperlinks to content not allowed on ALC Communications, including adult oriented sites and racial bigotry sites Copyright (c) ALC Communications, 1997 |
